Green in the Buckeye State: Navigating the Legal Landscape of Marijuana in Ohio

In 2016, Ohioans overwhelmingly passed Issue 3, which aimed to legalize marijuana cultivation, processing, and sales for recreational use. However, due to a legal challenge, the law was overturned before it could take effect. But don’t worry, our resolve didn’t wilt! Lawmakers rallied and, in 2016, passed Senate Bill 3, which established a comprehensive medical cannabis program.

Fast forward to today, Ohio’s Medical Marijuana Control Program (MMCP) is up and running, providing relief for qualifying patients. To be eligible, patients must have one of 21 debilitating medical conditions, such as cancer, HIV/AIDS, epilepsy, or PTSD. Qualifying patients can obtain a recommendation from a certified physician and, with that in hand, visit one of the state’s licensed dispensaries to purchase their medicine.

For those curious about the types of products available, Ohio’s MMCP offers a variety of options: dried flower, edibles, oils, tinctures, patches, and topicals. Each product contains a specific amount of THC (the psychoactive component of cannabis) and CBD (non-psychoactive).

But what about the gray area of hemp-derived products? Are they legal in Ohio? Yes, in some cases! Hemp-derived CBD products containing 0.3% or less THC are federally legal under the 2018 Farm Bill and can be bought over-the-counter in various retailers across the state.

However, it’s essential to remember that the legal landscape of cannabis is complex and constantly evolving. While medical marijuana is legal in Ohio, possession or consumption of recreational marijuana remains illegal and can result in significant penalties.
